This agreement is a contract between the customer (“you”) and Maximum Motorsport Pty Ltd (ABN 22 896 694 548),
2 Eternity Street Wangara WA 6065.
Please read the following terms and conditions carefully before placing your order with Maximum Motorsport. By completing and submitting the customer order online and using the Subaru Partsbox Website, you acknowledge that you have read and agree with the terms and conditions outlined below.
Maximum Motorsport reserves the right at all times to make changes to the Subaru Partsbox Website Terms and Conditions, product offers, pricing and specifications, at its sole discretion without prior notice.
Definitions
The following apply to these Terms and Conditions.
Agreement means an agreement between you and Maximum Motorsport to supply Goods.
Delivery Address means the address to which the Goods are to be delivered as stated on the Order.
Goods means Goods described in an Order.
Order means an order by you to purchase Goods from Maximum Motorsport.
Personal Information includes, but not limited to your name, Delivery Address and payment details.
Price of Goods and Payment
All product prices quoted are in Australian Dollars, and include GST. Prices shown do not include delivery. If stated you agree to pay the delivery and handling fee in respect to each product ordered and all applicable taxes in that regard.
Variation
Maximum Motorsport reserves the right to change or alter prices of products without notice. The price applicable shall be the price applicable on the date the Goods are confirmed as ordered.
Method of Payment
Payments may be made using Stripe (and any credit cards accepted by Stripe). The Subaru Partsbox Website does not accept cheque or cash for Goods. Payment must be cleared before the Goods are dispatched.
Delivery
Locations
From the Subaru Partsbox Website, Maximum Motorsport will only sell and deliver within Australia. Maximum Motorsport will not accept offers for the purchase of goods outside of Australia or which are to be delivered outside of Australia.
Risk & Title
Risk and title in the Goods passes to you upon delivery of the Goods to your nominated Delivery Address.
Delivery Requirements
In general, orders placed via the Subaru Partsbox Website must be sent to a delivery address.
Please contact Maximum Motorsport before placing your order, if you wish to collect the good from Maximum Motorsport. Please contact Maximum Motorsport via our Contact page, or call us on 08 9458 1444.
Orders placed on a weekend or on a NSW or WA Public holiday will not begin processing until the next business day.
Maximum Motorsport will not accept responsibility for late delivery or non-delivery due to incomplete or incorrect details provided.
Delivery
Delivery time is normally within three – six business days.
Delivery times may vary, depending on location. The normal method of delivery is by Selected Couriers and occasionally Australia Post Parcel Post and Express Parcel. Delivery times to locations serviced by Parcel Post and Express Post may be found on the Australia Post web site, and may change without notice.
Stock and Product Availability
When you place an order for goods from Subaru Partsbox Website, we will consider that you are offering to purchase the goods. We will confirm acceptance of your offer by sending you a confirmation email including a reference number. If we accept your offer, a binding contract will be formed incorporating these Terms and Conditions (where applicable).
Maximum Motorsport reserves the right to refuse to accept your offer or cancel orders at its sole discretion. If we do so, we will let you know.
In some cases, Maximum Motorsport or Subaru Australia may have limited stock of goods shown on this Website. In such circumstances Maximum Motorsport and Subaru Australia reserves the right to limit the number of goods any particular customer may order.
Cancellations
Please contact Maximum Motorsport on 08 9458 1444 if you wish to cancel your order.
Returns
Should you wish to exchange or return an item purchased online, please contact Maximum Motorsport on 08 9458 1444.
Please note that Goods to be returned must be unused, in its original packaging, and in a saleable condition. Please note that delivery fees and handling fees are non-refundable, unless required by law.
Privacy and Security
Personal information collected will be used for the purpose of processing the order, and may be shared with third party for the purpose of completing online payments or delivering your order.
Promotions and Discounts
Maximum Motorsport, at its discretion, may honour promotions, discounts or offers currently available in-store. However all advertised items are available only while stocks last, unless otherwise stated in the advertisement.
Applicable Laws
The laws of Western Australia, Australia govern this agreement.
This site is created and controlled by Maximum Motorsport. Your use of this site is governed by, construed and enforced in accordance with the laws of Western Australia, Australia. Disputes arising from your use of this site are exclusively subject to the jurisdiction of the courts of Western Australia, Australia.
This site may be accessed throughout Australia and overseas. Maximum Motorsport makes no representations that the content of this site complies with the laws (including intellectual property laws) of any country outside Australia. If you access this site from outside Australia, you do so at your own risk and are responsible for complying with the laws in the place where you access the site.
